1. Accepting these terms
These Terms of Use (“Terms”) apply to krystelhuertainsurance.com and its pages, forms, and tools (the “Site”), operated by Krystel Huerta Allstate Insurance Agency (“we,” “us,” or “the agency”). By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.
We may update these Terms from time to time. The “Effective” date at the top shows when they last changed. Changes apply going forward; they don’t change any dispute already pending.
2. Who we are and what the Site is
We are a licensed insurance agency located in Texas and an exclusive agent of Allstate. We serve customers in Texas. Insurance is offered by the Allstate family of companies and other insurers we are authorized to represent; availability, coverage, discounts, and rates depend on eligibility, underwriting, and the terms of each policy.
Using the Site does not bind coverage. No insurance is in force, and no coverage is changed, until an insurer accepts your application and issues or confirms the policy in writing. Submitting a form, receiving a quote, or exchanging messages with us does not by itself create coverage.
3. Quotes and proposals are estimates
Any quote, proposal, premium, or savings figure we provide is an estimate based on the information available at the time. Final rates and eligibility are determined by the insurer and may change based on underwriting, verification of the information you provide (for example driving, claims, and property records), and the coverage you choose. Savings and discounts vary and are not guaranteed.
4. Educational content
Articles, FAQs, and other content on the Site are general information to help you understand insurance. They are not legal, tax, or financial advice, and they don’t describe the terms of any specific policy. Your policy documents control what is and isn’t covered. If anything on the Site conflicts with your policy, the policy controls.
Reviews. Customer reviews shown on the Site are real reviews posted on our Google Business Profile, quoted as written (shortened excerpts are marked with “…”). We don’t pay for reviews or write them ourselves.
5. Information you submit
When you submit a form, you agree that the information is accurate and complete to the best of your knowledge and that it is yours to share (for example, information about other drivers or household members you are authorized to provide). Providing false or misleading information on an insurance application can affect coverage and claims.
We use what you submit as described in our Privacy Policy. We never sell your information or share it with other agencies.
6. Calls, texts, and emails
If you check a box or click a button on a Site form that displays our consent language (for example, “Get Quotes”), you give us your prior express written consent, by electronic signature, to contact you at the phone number and email you provide about your insurance quote and related insurance products and services. That contact may include calls and text messages that use automated technology or an artificial or prerecorded voice, even if your number is on a state or national Do Not Call list.
- Not a condition of purchase. You don’t have to agree to buy anything from us. You can call us at (512) 691-6400 instead.
- Texts. Message frequency varies. Message and data rates may apply. Reply STOP (or OPT OUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE — or ALTO, PARAR, CANCELAR, BAJA) to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages.
- Revoking consent. You can revoke consent at any time by any reasonable means — replying STOP, telling us on a call, emailing khuerta@allstate.com, or calling us. We will honor your request promptly and no later than 10 business days after we receive it.
- Calls may be recorded for quality, training, and record-keeping. We will tell you at the start of a call if it is recorded.
- Right number. Please tell us if your number changes or is reassigned so we stop contacting it.
7. Electronic signatures and records (E-SIGN consent)
You agree that clicking a button or checking a box on the Site to accept these Terms or to give consent is your electronic signature, with the same effect as a handwritten signature, under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Texas Uniform Electronic Transactions Act. You also agree that we may provide disclosures, notices, and records to you electronically — for example on the Site, by email, or by text.
To view and keep these records you need a device with internet access, a current web browser, and an email account. You can request a paper copy of any record or withdraw consent to electronic records at no charge by emailing khuerta@allstate.com or calling (512) 691-6400. Withdrawing consent to electronic records doesn’t cancel any consent you gave to be contacted unless you also revoke that.
8. Acceptable use
Please don’t:
- submit information about someone else without their permission, or impersonate anyone;
- submit spam, automated or bot traffic, or test submissions with fake contact details;
- scrape, copy, or harvest the Site’s content or data, or try to access systems you’re not authorized to use;
- interfere with the Site’s security or operation, or upload malicious code; or
- use the Site for anything unlawful.
We may block access or ignore submissions that violate these rules.
9. Intellectual property
The Site’s text, design, graphics, and logos belong to us or our licensors. “Allstate” and related marks are trademarks of Allstate Insurance Company and are used with permission. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.
10. Third-party sites and tools
The Site links to and uses services run by others (for example Allstate.com, Google, and social networks). We don’t control those sites or tools and aren’t responsible for their content or practices; their own terms and privacy policies apply. A link is not an endorsement.
11. Disclaimers and limitation of liability
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we don’t guarantee the Site will be uninterrupted or error-free.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, and our total liability for any claim relating to the Site is limited to $100.
This section applies only to your use of the Site. It does not limit any rights you have under an insurance policy, the Texas Insurance Code, or other laws that cannot be waived, and it does not limit liability for our gross negligence, fraud, or willful misconduct.
12. Dispute resolution and arbitration
Please read this section carefully — it affects your rights, including your right to go to court and to bring a class action. When you submit a form on the Site, you’re asked to agree to these Terms — including this section — right above the submit button. It covers disputes about the Site, these Terms, and our communications with you (including calls and texts). It does not cover claims under an insurance policy, which are governed by the policy and applicable insurance law.
1. Talk to us first
Before starting arbitration, the party with a claim must send a written notice describing the claim and the relief requested — to us at khuerta@allstate.com, or to you at the contact information we have. Both sides will try in good faith to resolve it informally for 30 days. All statutes of limitations and filing-fee deadlines are tolled while this informal process is underway.
2. Binding individual arbitration
If the dispute isn’t resolved, it will be decided by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (available at adr.org), as modified by this section. The Federal Arbitration Act governs this agreement. The arbitrator may award the same individual relief a court could, decides questions of arbitrability except as stated below, and will hold any hearing in the Texas county where you live or by video or phone.
3. Costs
We will pay all AAA filing, administration, and arbitrator fees for any arbitration you start under this section, except that if you start it you will pay the consumer filing fee only up to what you would have paid to file in court, which we will reimburse if you win. Each side pays its own attorneys’ fees unless the law or the arbitrator awards otherwise.
4. Mass Arbitration
If 25 or more similar arbitration demands are filed against us by the same or coordinated counsel, they will be administered under the AAA’s Mass Arbitration Supplementary Rules then in effect, and all limitations periods for those claims are tolled while they are pending. A court may enforce this paragraph.
5. Class action and jury waiver
You and we each agree to bring claims only in an individual capacity — not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding — and each waive the right to a jury trial. If this class-action waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court, not arbitration. A court, not an arbitrator, decides disputes about this paragraph.
6. What’s not covered
- Small claims: either side may bring an individual claim in small claims court (Texas justice court) if it qualifies.
- Regulators: nothing here stops you from filing a complaint with, or seeking relief available through, the Texas Department of Insurance, the Texas Attorney General, the Federal Communications Commission, the Federal Trade Commission, or any other government agency.
- Either side may seek an injunction in court to stop infringement or misuse of intellectual property or unauthorized access to systems.
7. Your right to opt out
You can opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing khuerta@allstate.com with the subject “Arbitration Opt-Out” and your name, phone, and email (or by mailing the same information to the agency — call (512) 691-6400 for our current mailing address). Opting out does not affect any other part of these Terms.
13. Governing law and venue
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. For any dispute that is not arbitrated, you and we agree to the exclusive jurisdiction of the state and federal courts located in the Texas county where the agency maintains its principal office, except that you may bring an individual claim in the Texas county where you live.
14. General
These Terms and the Privacy Policy are the entire agreement about the Site. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn’t a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a sale or reorganization of the agency.
